Terms and Conditions

A lead, as defined by Genr8, is an individual or business that has expressed interest in your products or services. This interest may be demonstrated through various actions, such as filling out a form, engaging with content, requesting more information, or otherwise indicating a desire to learn more about what your business offers. Leads provided by Genr8 are curated to align with your business's target audience, ensuring they have a higher likelihood of converting into customers.

• Genr8 will deliver leads directly to the CRM system.
• All leads are provided in real-time and are deemed "hot," meaning they are fresh and ready for immediate follow-up.
• Upon delivery of each lead, Genr8 will immediately charge the client's credit card for the lead, based on the agreed per lead cost.

• Genr8 makes every effort to provide high-quality leads that match your specified criteria. However, the conversion of these leads into customers is dependent on the client's follow-up and sales process.
• Genr8 does not guarantee the conversion of leads into customers or any specific revenue outcome.

• Once delivered, the lead becomes the property of the client. Genr8 retains no rights or responsibilities for the lead beyond initial delivery.

• Given the nature of digital lead generation, all sales are final. Genr8 does not offer refunds or exchanges for leads once they have been delivered.
• Exceptions may be made in cases where a lead is demonstrably invalid or non-existent, subject to Genr8's review and approval.

• Genr8 adheres to strict data privacy regulations. All leads are generated in compliance with relevant laws, ensuring that personal data is handled responsibly.
• Clients are expected to handle all lead data in accordance with applicable data protection laws and regulations under New Zealand law.

• Clients are responsible for following up on leads promptly to maximise conversion potential.
• Clients must provide accurate and up-to-date information about their target audience to ensure the quality of leads generated by Genr8.

• Genr8's lead generation service is designed to provide leads based on the information and criteria provided by the client. However, Genr8 does not control the actions of the leads once delivered.
• The effectiveness of the leads in generating business is influenced by factors beyond Genr8’s control, including the client’s sales strategy, market conditions, and product offerings.

• Genr8 reserves the right to modify or discontinue its services at any time, with or without notice, in response to business needs or legal requirements.

• Genr8 shall not be liable for any indirect, incidental, or consequential damages resulting from the use of its services.
• The total liability of Genr8, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the client for the leads in question.

• Payment terms are strict. Monthly base fee payments are due by the first of each month via automatic payment, either through Genr8's website or by direct debit.
• Payments for leads generated are due no later than the week following delivery. Failure to pay by this deadline will result in an immediate penalty fee of $100 per invoice to cover the admin fee and interest at a rate of 5%.
• If payment is not made within 14 days of the invoice due date, an additional $100 admin fee and 5% interest will be added. At this point, the debt will also be submitted to Baycorp (debt collection agency), and all associated legal fees and debt collection fees will be the client's responsibility.
• The client will also be banned from using Genr8’s services moving forward if payments are not made within these timeframes.

• These terms and conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from or related to these terms shall be resolved in the courts of New Zealand, and the client agrees to submit to the jurisdiction of these courts.

• By using Genr8’s services, the client agrees to these terms and conditions in full. If the client does not agree with any part of these terms, they should not use the service.

The lead has actively engaged with a designated call-to-action:

The CTA engagement indicates a clear interest in the client’s product, service, or offer, as the lead has taken a proactive step towards initiating contact or receiving more information.
